Binding Arbitration
This Agreement includes a Binding Arbitration clause, which means that any disputes between you and Cofable will be resolved through arbitration, governed by the Federal Arbitration Act (FAA). This applies to disputes related to our products, services, or purchases made through Cofable.
Neither party will have the right to litigate disputes in court or seek a jury trial.
You may bring disputes to small claims court if eligible.
Arbitration is final and binding, with limited discovery and appeal rights.
Note: Class action waivers apply. You cannot join disputes involving other customers in arbitration.

Modifications to Terms
Cofable reserves the right to update these Terms of Service at any time. Material changes will become effective 30 days after they are posted on the site. It is your responsibility to review these Terms regularly.

Commencement of Disputes
At Cofable, we value transparency and open communication. If you encounter any issues or disputes related to our services or products, we encourage you to contact us directly before proceeding with any formal actions. To initiate a dispute, please send a written notice to Cofable@outlook.com.
This notice should include:
Your full name and residential address
Phone number
Email address registered with your Cofable account (if applicable)
A detailed explanation of your claim and requested relief
Supporting documentation, if necessary

We aim to resolve disputes amicably, and you and Cofable agree to negotiate in good faith for a period of sixty (60) days from receipt of the notice. During this time, you may request a phone or video conference to help facilitate resolution. Both parties must attend the conference in person (with legal counsel, if applicable). If the sufficiency of the notice or compliance with this process is disputed, either party may raise the issue with a court of competent jurisdiction. Any ongoing arbitration will be stayed until this issue is resolved. All limitations, including statutes of limitations, will be tolled during this dispute resolution process.

Arbitration of Disputes
Any disputes that cannot be resolved amicably will be subject to arbitration, conducted by a neutral arbitrator agreed upon by both parties. The arbitration will follow the current rules of the National Arbitration and Mediation (NAM) and will be administered in accordance with the Comprehensive Dispute Resolution Rules. If NAM is unavailable, the parties will mutually agree on an alternative administrator. If no agreement is reached, the court will appoint an arbitrator.
The arbitrator’s award may include the costs of arbitration, reasonable attorney’s fees, and other necessary expenses. The decision of the arbitrator will be final, except as allowed under the Federal Arbitration Act (FAA). You may seek provisional remedies from a court if necessary to protect your rights during the arbitration.

Remedies
The arbitrator has the authority to award remedies that are available in individual lawsuits under applicable law, including, but not limited to, compensatory, punitive, and statutory damages, equitable relief, and attorneys’ fees. The arbitrator’s award can be enforced by any court with proper jurisdiction. Provisional remedies can also be sought from a court to aid arbitration.

Class Action Waiver
You and Cofable agree to waive the right to participate in class, consolidated, or representative actions. This applies to disputes resolved through arbitration or in court. No dispute may be arbitrated or litigated as a class action unless explicitly agreed upon by both parties. If any provision of this waiver is found to be unenforceable, it will be severed, but the rest of the waiver will remain in effect.

Equitable Relief
In the event of a breach of intellectual property or confidential information, Cofable may seek immediate injunctive relief to protect its rights. This action does not waive other legal remedies available under this agreement.

Termination
Cofable reserves the right to terminate accounts or services if necessary, without prior notice. Upon termination, you must immediately cease accessing our site and services. Any termination will not affect obligations or rights that arose prior to the termination.

Disclaimer & Limitation of Liability
Cofable provides its products and services on an “as-is” basis. We make no representations or warranties about the accuracy, completeness, or reliability of our site, products, or services, except as otherwise specified by law. To the fullest extent permitted by law, Cofable will not be liable for any indirect, incidental, punitive, or consequential damages arising from the use of our services. Our total liability to you shall not exceed the total amount you paid to Cofable in the past month.

Choice of Law and Forum Selection
This agreement and any disputes arising out of it will be governed by the laws of the State of Texas. Disputes will be heard exclusively in state or federal courts in Texas.

Order Acceptance
Cofable reserves the right to refuse or cancel any orders at its sole discretion. This may include, but is not limited to, issues with product availability, inaccuracies in pricing or product descriptions, or problems identified by our fraud prevention team. If your order is canceled, you will be notified, and no further action is required.
